Montana Implement

Montana Implement warrants all products to be free from defects in material and workmanship for the life of the product when used properly for the designed service applications.  The purchaser shall be responsible for promptly informing Montana Implement Customer Service of any perceived operational deficiencies or failures. Any product or part believed to be defective may be returned freight prepaid by purchaser, after approval from Montana Implement Customer Service Department.  If, following our inspection, the product is determined to be defective in materials or manufacturing and meets other specific warranty requirements; repair or replacement will be made to the customer at no charge and returned freight prepaid by Montana Implement.  Montana Implement will be the sole party responsible for analysis of perceived operational deficiencies or failure.  Products determined to not be warrantable shall be returned to the purchaser at their expense and/or Montana Implement will make an offer to repair or replace the non-warrantable product at the expense of the purchaser.

 

The Montana Implement Limited Warranty is extended only to the original purchaser and may be void in the event that the product is sold or otherwise transferred. Montana Implement Limited Warranties are valid only in the United States and Canada. No warranty will apply to any product that has been (a) modified, altered or adapted without Montana Implement’s written consent, (b) abused or misused, (c) repaired by any third party in a manner which fails to meet Montana Implement's repair standards, (d) improperly installed (e) used with any device or implement not covered by this warranty, or (f) used outside of the United States or Canada. This warranty does not include and hereby excludes normal wear and tear and normal maintenance parts and consumables, including but not limited to belts, oil, fuel filters and similar items.

 

Warranty is applicable only upon the approved return of the product(s) to Montana Implement or approved field repair authorized by Montana Implement. In some cases, Montana Implement may approve field repairs. Compensation for field repairs will be negotiated prior to work being performed, and field repairs undertaken without approval by Montana Implement Customer Service will void this warranty.  No warranties are expressed or implied as to the fitness of the equipment on which the product is installed.  Products which do not fit because of incorrectly provided specifications are not returnable, are not covered by this limited warranty, and constitute the property of the purchaser.

This warranty constitutes the final, complete and exclusive statement of warranty terms.  No person or organization is authorized to make any other specific or implied warranties or representations on behalf of Montana Implement.  A new warranty period will NOT be established for the repaired or replaced products.  Such products shall remain under warranty only for the remainder of the original warranty period on the original product(s) purchased.

THE WARRANTIES SET FORTH HEREIN ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES EXPRESS OR IMPLIED INCLUDING THE WARRANTIES OR MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE PURCHASER ACKNOWLEDGES THAT NO OTHER REPRESENTATIONS OR WARRANTIES WERE MADE OR RELIED ON IN CONNECTION WITH THE PURCHASE OF THE MONTANA IMPLEMENT PRODUCTS. NO PERSON IS AUTHORIZED TO VARY, MODIFY OR CHANGE THE TERMS OF THIS LIMITED WARRANTY.

NEITHER PARTY SHALL BE LIABLE FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGE IN CONNECTION WITH OR ARISING OUT OF THE USE OF THE PROPERTY SOLD TO THE PURCHASER INCLUDING WITHOUT LIMITATION LOSS OF BUSINESS, REVENUE, PROFITS GOODWILL OR CONSEQUENTIAL DAMAGES WHETHER IN CONTRACT OR TORT INCLUDING NEGLIGENCE.  IN NO EVENT SHALL MONTANA IMPLEMENT’S LIABILITY EXCEED THE ENTIRE AMOUNT PAID TO MONTANA IMPLEMENT BY THE ORIGINAL PURCHASER FOR THE FAILED OR DEFECTIVE PRODUCT.

 

Nothing in this warranty affects any statutory rights of consumers or other purchasers that cannot be waived or limited by contract. This limited warranty gives you specific legal rights, and you may have other rights which vary from state to state.
